ARTICLE 1. GENERAL PROVISIONS

Sec. 1.1 Hours of Operation

The Campus Police office is located in Vance Hall. The Campus Police Patrol and Communications Divisions are open 24 hours a day, 7 days a week. The Parking Division office hours are generally 7:30 a.m. to 5 p.m. Monday –Friday, except holidays and campus breaks.

Sec. 1.2 Liability

The University of North Carolina at Asheville assumes no liability or responsibility for damage or theft to any vehicle parked in or on the university properties. The provisions of these regulations shall apply to all operators of all vehicles, public and private, and they shall be enforced twenty-four hours a day except where otherwise specified by these regulations.
The operator of any vehicle shall obey the lawful instruction of any law enforcement officer, parking control officer, official traffic signs or control devices appropriately placed in accordance with the provisions of these regulations.

Sec. 1.3 Rules of Evidence

When a vehicle is found to be in violation of these regulations, it shall be considered prima facie evidence that the vehicle was parked by:

a. The person to whom the university parking permit for the vehicle is registered;

b. If no parking permit has been issued for the vehicle, the person, company, corporation or firm in whose name the vehicle is registered with the North Carolina Division of Motor Vehicles or the corresponding agency of another state or nation; or

c. The son, daughter, spouse or ward of the registered owner enrolled in or employed by The University.
The prima facie rule of evidence shall not apply to the registered owner of a leased or rented vehicle when said owner can furnish evidence that the vehicle was, at the time of the parking violation, leased or rented to another person. In such instances, the owner of the vehicle shall, within reasonable time after notification of the parking violation, furnish the Campus Police with the name and address of the person or company who leased or rented the vehicle.

Sec. 1.4 Driver Responsibility

The responsibility of finding an authorized parking space rests with the driver of the vehicle. Lack of convenient parking space, mechanical problems, inclement weather conditions or other issues are not considered valid excuses for failure to comply with these parking regulations.

Sec. 1.5 Space Availability

A parking permit does not guarantee the holder a space in any particular lot. Lack of a convenient space is not a valid excuse for parking in violation of these regulations.

Sec.1.6 Filing a Police Report

Police Reports can be filed by contacting Campus Police in person or by phone. Reports should be filed as soon as possible after an incident has occurred. Filing a false police report can result in a fine and/or disciplinary action.

Sec. 1.7 Vehicles with Mechanical Problems

If mechanical failure results in a potential violation of the parking regulations, the owner should contact Campus Police immediately. The owner will be provided with a Disabled Vehicle Permit. This permit should be placed on the front dash of the vehicle so that all information is visible. Vehicles not moved within 72 hours will be considered abandoned and will be towed at the owner's expense.

Sec. 1.8 Abandoned Vehicles

The Campus Police will attempt to contact the registered owner of any vehicle parked on campus that appears to be derelict or abandoned. When a vehicle is declared to be derelict or abandoned on any property under the control of the University of North Carolina at Asheville, Campus Police shall place a tag on the vehicle as notice to the owner, the person in possession, or any lien holder of the vehicle that it has been declared abandoned. Vehicles not moved within five (5) days of being so tagged, shall be towed from the property and the registered owner shall be notified that the vehicle is being held in accordance with NC G.S 20-137.7.

Sec. 1.9 Enforcement

a. Under applicable Motor Vehicle Laws of the State of North Carolina, the Board of Trustees of The University of North Carolina at Asheville is vested with the responsibility for control and management of the University. (North Carolina General Statutes 116-44.4.)

b. Officers or other employees of The University of North Carolina at Asheville Campus Police shall be responsible for enforcing the Regulations Governing Traffic, Parking, and Vehicle Registration of Motor Vehicles on campus and issuing citations for violations of these regulations.

c. Regulations are enforced 24 hours a day, 365 days a year. It is not necessary to receive a warning notice before a citation is issued.

d. Any portion of a vehicle parked in a restricted area constitutes a violation.

ARTICLE 2. TRAFFIC

Sec. 2.1 Traffic Regulations

a. Speed Limit: It is unlawful to operate a vehicle on designated streets and roadways of the campus in excess of 20 mph. unless otherwise posted. It is unlawful to operate a vehicle in excess of 10 mph in all other vehicular areas of the campus.

b. Moving Traffic Violations: The Campus Police has the responsibility to enforce all traffic regulations approved by the Board of Trustees.

Sec. 2.2 Official Signs and Notice

The Director of the Facilities Management Department shall be the University official responsible for erecting signs as called for by these regulations. When signs are erected, placed, or installed, no person shall drive or otherwise operate a vehicle on The University of North Carolina at Asheville campus except in accordance with these official traffic signs. It is unlawful for any person to deface, damage, tamper with, break, destroy, impair the usefulness of, remove, relocate, steal, or in any way injure any official sign erected by The University of North Carolina at Asheville. Possession of any such sign shall be prima facie evidence of a violation of this regulation.

a. Speed Limit Signs: The operator of any vehicle shall not exceed 20 mph on the roadways of the campus unless otherwise posted. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation.

b. Stop Signs: When Stop Signs are erected, placed or installed upon any street or roadway intersecting any other street or roadway, the operator of a vehicle shall stop at every such sign before proceeding into the intersection. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation.

c. Yield Signs: When Yield Signs are erected, placed or installed upon any street or roadway, the operator of the vehicle shall yield at every such sign before proceeding into the street or roadway. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation

d. Do Not Enter Signs: When Do Not Enter signs are erected, placed or installed upon any street or roadway, the operator of a vehicle shall not proceed beyond the sign onto any street, roadway, or vehicular area. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation.



Sec. 2.3 Crosswalks

Pedestrians have the right-of-way throughout the entire campus at all times. Crosswalks will be designated by signage and diagonal lines on the road surface or by brick paved sections of the roadway. Parking or loading and unloading in crosswalks are prohibited. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the driver’s expense.

Sec. 2.4 Sidewalks and Walkways

Motor vehicles, mopeds, roller skates of any kind, roller blades and skateboards are prohibited on campus sidewalks and walkways. A university citation may be issued for violation of this regulation. Sidewalks and walkways are primarily for pedestrians. Bicycles must yield to pedestrians at all times.

Sec. 2.5 Interference with Traffic

It is unlawful for the operator of a vehicle to park in such a manner as to interfere with normal vehicular or pedestrian traffic on the campus. Traffic may be temporarily restricted or rerouted as necessary by construction, emergency situations, and special events. Notice of such restrictions must be reported to the Campus Police immediately. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the driver’s expense.

Sec. 2.6 Law Enforcement Regulations

Vehicle operation and parking may be prohibited under emergency and/or other law enforcement operational necessities. It shall be unlawful for any person to violate law enforcement instructions related to this section. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation.

Sec. 2.7 Moving Traffic Violations

All motor vehicle laws of the State of North Carolina are enforced by Campus Police.

a. University citations or North Carolina Uniform citations may be issued for violation of moving traffic laws.

b. University traffic citations may be appealed to UNC Asheville’s Chief of Campus Police and then to the Associate Vice-Chancellor for Campus Operations.

c. North Carolina State Uniform citations will be handled in the appropriate District Court.




ARTICLE 3: PARKING REGISTRATION AND PERMITS

Sec. 3.1 Vehicle Registration

All vehicles parked on campus are required to have a valid parking permit during normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks).

a. Sophomore, Junior, and Senior Students may park a vehicle on campus in designated areas (see Campus Map) provided it is properly registered with Campus Police. A valid student ID card, receipt for fees paid or a class schedule cleared by the Business Office, along with the Vehicle Registration Card, properly completed, must be submitted before a parking permit will be issued. Students are financially responsible for any vehicle to which a permit is issued. Any student who knowingly allows the use of their permit for any purpose other than the intended, can have their parking privileges revoked.

b. Faculty and Staff may park a vehicle on campus in designated areas (see Campus Map) provided it is properly registered with the Campus Police. The Vehicle Registration card, properly completed, and payment of the appropriate fee or a completed Payroll Deduction form must be submitted before a parking permit will be issued. This may be done in person in Vance Hall or by campus mail. Faculty and Staff are financially responsible for any vehicle to which their hangtag is attached. Any faculty or staff member who knowingly allows the use of their hangtag for any purpose other than the intended will have their parking privileges revoked.

c. All UNC Asheville parking permits expire on May 31 of each year. New permits for each new academic year must be displayed no later than the first day of classes.

d. Unregistered Vehicles. Students, faculty and staff will be held financially responsible for citations issued to unregistered vehicles traced to direct family members.

Sec. 3.2. Parking Permit Fees

Fees are regularly reviewed by the Board of Trustees and may be changed without otherwise affecting these regulations.

a. Parking fees for UNCA undergraduate or MLA students are included in the required fee package. Other students, faculty/staff, and facility user parking fees are paid separately upon registration of their vehicle.

Sec. 3.3. Displaying Parking Permits

a. Hangtags and any other hanging permit, permanent or temporary, must be hung from the rear view mirror with the printed side facing outward toward the windshield so that all information is visible from outside the vehicle. Obstructions preventing the clear visibility of hangtags will result in a citation for “Improper Display of Permit.”

b. Decals must be peeled and affixed to the rear window shield upper right corner (do not place over rear windshield wiring for rear defroster) in such a manner that all letters and numbers are visible. Decals placed in any other manner or location will be in violation and citations will be issued.

c. Permits designed to be displayed on the dash of a vehicle shall be placed on the driver’s side dash so that all information is visible through the windshield.

d. Motorcycles must display their permits on the front fork.
Defaced, altered, reproduced, forged, counterfeited or unauthorized possession of permits will result in a $100 fine and/or loss of parking privileges. State owned vehicles are not required to display a parking permit.

Sec. 3.4 Special Parking Permits

All vehicles parked on the campus of the University of North Carolina at Asheville are required to display a valid parking permit 7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks. Departmental chairs, faculty, staff, students, sponsors, and host/hostesses must obtain Visitor Parking Permits, Conference Parking Permits, or Special Event Parking Permits for their visitors, guests, and special groups. The University of North Carolina at Asheville reserves the right to assess a fee for any parking permit at any time.

a. Temporary Permits: A Temporary Parking Permit will only be issued 7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks, only to a member of the campus community whose registered vehicle is being repaired and who is parking an unregistered vehicle on campus. Temporary Permits can only be issued for a maximum 7 days. Temporary Permits that are altered in any way will be considered invalid, and parking privileges may be revoked. Temporary Permits will not be issued in lieu of a required parking permit.

b. Visitor Parking Permits: All visitors to the campus must display a valid Visitor Parking Permit 7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks. Visitor Permits will only be issued Monday thru Friday from 7:30 am – 5:00pm, except with display of an Overnight Guest Pass.

1. A visitor is any person on the campus of the University of North Carolina at Asheville who is neither a student, graduate student, NCCCR student, Service personnel, Board of Trustees, facility user, nor a faculty, staff, temporary employee, or adjunct faculty member.

2. It is the responsibility of the departmental chair, faculty, staff, student, or sponsor to make sure that their guests have the proper parking permit and instructions. These permits are available in the Campus Police Office in Vance Hall.

3. Visitors who receive a parking citation may turn them in to their host/hostess or bring them to the Campus Police Office in Vance Hall. If a visitor has not received a citation on campus before, citations are often dismissed with a warning. Citations related to misuse of “handicap” space, 15-minute spaces, fire lane/zone or moving traffic offenses would not be voided. Visitors who receive a warning citation will be billed for all future violations.

4. Some conference and special event participants may be required to pay a fee for parking.

c. Board of Trustees Pass: Special Board Passes may be issued annually to members of the Board of Trustees or The University Foundation Board. These special passes should be used only for official meetings or board business and are not to be used in lieu of any required parking permits. Board Passes are valid only for the Board Member and are not transferable. Service Vehicle permits: Service Vehicles parked in Service Vehicle parking spaces must have a Service Vehicle permit unless the vehicle has a Contractors emblem on the vehicle. Contractors directly associated with a Building projects must get permits via Contract Manager in Campus Operations.

d. Handicap (Accessible) Parking: All valid “Handicap” Permits, as defined by NC G.S. 20-37.6, will be honored on campus. However, “Handicap” Permits may not be used in lieu of a valid parking permit. Vehicles displaying a “handicap” hangtag or license may park in any space marked for “handicap” parking or if none is available, in any faculty/staff or student space. Emergency or fire lanes, service vehicle spaces, visitor spaces, reserved spaces, and no parking zones may not be used for “handicap” parking.

1. Persons who are temporarily disabled may request a Temporary “Handicap” Parking permit from Campus Police. Temporary “Handicap” permits may not be issued for more than three (3) weeks. State law requires a doctor’s note that states the duration of need be submitted before the permit can be issued. Persons displaying a Temporary “Handicap” permit are entitled to the same parking considerations and restrictions as the permanently “handicap”. Persons whose need exceeds three (3) weeks must obtain a state-issued permit from the North Carolina Division of Motor Vehicles. “Handicap” parking permits issued by The University of North Carolina at Asheville are valid only on the UNCA campus.

e. Alternative Fuel & Carpool Permits: An Alternative Fuel & Carpool Permit is valid only for designated alternative fuel/ carpooling parking spaces and commuter student parking lots. The number of parking spaces available is limited and permits will be issued on a first come-first served basis. This permit is only available to Commuter students (resident students can not obtain an Alternative Fuel & Carpool Permit). If no permits are available, a waiting list is available.

1. Carpool Permits may be obtained by two (2) or more adults (17 years of age or older) registering as a carpool.

i. Register on www.sharetheride.org.

ii. No other permanent parking permit can be obtained by any party in a
carpool. All persons requesting a carpool permit must visit Campus Police at the same time.

iii. Permit and citations costs issued to a vehicle displaying the Alternative Fuel
& Carpool Permit will be split between users.

iv. Designated carpooling spaces may not be used if vehicle has no passenger(s). Vehicle must park in Commuter Parking Lots with no passenger(s) or if all Alternative fuel & carpool spaces are full.

2. Alternative fuel vehicles or hybrid vehicles must submit a vehicle registration showing the owner of the vehicle and the vehicle type.
i. For flex-fuel vehicles, the owner must submit receipts for past purchases of alternative fuel and/or a written statement provided to Campus Police explaining the type of fuel used and how the fuel was obtained.

Sec. 3.5 Temporarily Removed, Stolen, Altered, or Falsified Permits

Any student, faculty, staff, or any other permit holder who knowingly allows the use of their parking permit for any purpose other than the intended use will have their parking privileges revoked. Possession of or displaying a parking permit that has been stolen, defaced, removed from a windshield temporarily, altered, or reproduced, or possession of a permit for a parking area other than the classification of the permit holder is prohibited and will result in fine of $100 and/or the revocation of parking privileges.

Sec. 3.6 Lost or Stolen Permits

Lost or stolen permits should be reported to the Campus Police immediately. It is the permit holder’s responsibility to take the necessary steps to replace the permit. Lost or stolen permits not reported will remain the responsibility of the original owner. Stolen permits will be replaced (only once per year) once a Police Report has been filed. Penalty for filing a false report of a stolen permit is a $100.00 fine.

Sec. 3.7 Official Signs and Notices

a. No Parking Zone Signs: When No Parking signs are erected, placed, or installed upon any street or roadway, the operator of a vehicle shall not park a vehicle in this area. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the owner’s expense.

b. Fire Zone Signs: When Fire Zone signs are erected, placed, or installed upon any street or roadway, the operator of a vehicle shall not park a vehicle within thirty (30)
feet of the sign. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the owner’s expense.

c. Service Vehicle Parking Only Signs: When Service Vehicle Only signs are erected, placed, or installed upon any street or roadway; the operator of a vehicle shall not park a vehicle in this area. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the owner’s expense.

d. Bus Stop Signs: When Bus Stop signs are erected, placed, or installed upon any street or roadway, the operator of a vehicle shall not park a vehicle in this area. A University citation or a North Carolina Uniform citation may be issued for violation of this regulation, and the vehicle may be towed at the owner’s expense.



ARTICLE 4: PARKING REGULATIONS

Sec. 4.1 Parking Zone Designations

Unless otherwise designated by signs or directives, the following zones are designated by painted lines and/or curbs:

• White Lines (not marked “Visitor”) = Student parking, both resident and commuter

• White Lines (marked “Visitor”) = Visitor parking only

• Green Lines = Faculty and staff parking

• Blue Lines, Diagonals and Curbs = “Handicap” parking only

• Red Lines and Curbs = Fire Zone, Emergency vehicle parking only

• Orange Lines and Curbs = Service Vehicle parking only

• Yellow Lines and Curbs = No Parking at any time

Sec. 4.2 Student Parking

a. Resident Students All resident students must park in lots specifically designated for resident student parking at all times (This includes evenings, weekends and holidays). Monitoring of parking lots during the weekends or holidays for parking out side of Resident parking lots will be enforced. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) Resident students may use 15-minute parking spaces for loading and unloading, but may not exceed the 15-minute limit.

b. Commuter Students Commuter students may park in any lot designated as commuter student. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) Commuter students are not allowed to park in resident student lots at any time. Commuter students may park in faculty/staff lots after normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks).

c. Freshman Students - UNC Asheville's New Freshman Resident students are NOT permitted to park cars on campus for the duration of their freshman year (Fall & Spring semesters). This includes Transfer Freshmen who have less than 25 semester hours. Freshmen may complete the “New Freshman Parking Application” to seek a waiver to this policy. Freshmen who are granted a waiver to this policy will be notified by the Hearing Officer of their designated parking location and any additional policies to those stated in this document. Freshmen can appeal the Hearing Officer’s decision to the Transportation Committee (see Article 6).

d. Graduate Students Graduate students may park in any lot designated as commuter student. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) Graduate students are not allowed to park in resident student lots at any time. Graduate students may park in Faculty/Staff lots after normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks).

e. North Carolina Center for Creative Retirement These students may park in any lot designated as commuter student. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) These students are not allowed to park in resident student lots at any time. These students may park in faculty/staff lots after normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks).

Sec. 4.3 Faculty and Staff Parking

Faculty and staff may park in any lot designated as faculty/staff parking. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) There are no specific lots assigned to certain buildings or departments. All parking is on a first-come, first-served basis. Faculty and staff may park in commuter student lots after normal business hours (During evenings 5:00 p.m. to 7:30 a.m. Monday – Friday, including holidays and campus breaks). Faculty and staff may not park in resident student lots except during the summer session or during breaks and holidays.

Sec. 4.4 Facility User Parking

Facility users are those people who are neither faculty/staff nor student, but who are frequent users of the University’s facilities. Facility users must park in lots designated as commuter student. (See the UNC Asheville Campus Parking Map for specific lot numbers and locations.) Facility users may park in lots designated as faculty/staff after normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks). Facility users are subject to all parking regulations, and citations will be issued for any violations of these regulations. Failure to pay fines may result in the loss of parking privileges.

Sec. 4.5 Fire Lanes

No person shall park a vehicle, whether attended or unattended, within 15 feet in either direction of a fire hydrant or in any area designated as a fire lane.

Sec. 4.6 No Parking (Yellow) Zones

No person shall park a vehicle, whether attended or unattended, in any area designated, whether by signs or painted curbs (yellow), as a non-parking zone.

Sec. 4.7 Other Parking

Certain lots may be designated for general parking. Any faculty, staff, commuter student, or facility user with a valid permit may park in these lots at any time. Resident students are not permitted to park in general parking lots at any time. The Director of Campus Police may authorize general parking in any other areas as needed (e.g., athletic or special events).

a. The “Church parking lot” located at the Covenant Reformed Presbyterian Church on Edgewood Rd. is considered a “general parking” area, but has special policies governing its use.

a. No Resident students can park in the “Church parking lot” at any time.

b. UNC Asheville faculty, staff students and guests are only permitted to park in this lot Monday-Friday 7:30am -9pm.

c. Repeated parking in this parking lot outside specified hours will result in ticketing and/or towing of a vehicle.

b. The Botanical Garden at Asheville parking is only for visitors to the Botanical Gardens.

Sec. 4.8 Motorcycle Parking

Motorcycles are subject to the same traffic and parking regulations as motor vehicles. Motorcycle spaces are indicated with an “M” on the campus map. Operators of motorcycles are required to purchase a motorcycle-parking permit. Motorcycles are prohibited on all campus walkways and sidewalks. A University citation may be issued for violation of this regulation.

Sec. 4.9 Bicycle Parking

Bicycles must be parked in bike racks. Bike racks are located outside academic buildings, residence halls, and throughout campus. Bikes cannot be parked blocking walkways, nor attached to trees, signposts, handrails, or to any other piece of University property other than bicycle racks. Bicycles that are repeatedly parked illegally may be temporarily confiscated or locked in place. To prevent theft and to support improved bicycling facilities on campus, bicycle owners are encouraged to register their bicycles at Campus Police during normal business (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks). Missing or stolen bicycles should be reported to Campus Police.

Sec. 4.10 15-Minute Parking


15-minute parking spaces are monitored 24/7 and designed to allow quick access to places like the bookstore, resident halls, administration buildings, and the Campus Police offices. A vehicle does not need a permit to park in a 15-Minute Parking space. Vehicles exceeding the 15-minute time limit will be issued a University citation. Ticketing can occur after 15 minutes for each 15-minute period that the vehicle remains in the space. After one hour, a boot will be placed on the vehicle and all citations plus a $25.00 boot removal fee must be paid before the boot will be removed.

Sec. 4.11 Overnight Parking


The Campus Police should be notified if a vehicle is left near an academic building after midnight or overnight.




ARTICLE 5. ENFORCEMENT


Sec. 5.1 Parking Violations

Persons or vehicles found in violation of Regulations Governing Traffic, Parking, and the Registration of Motor Vehicles for The University of North Carolina at Asheville will be issued a citation, with penalties as indicated on the citation. No parking permit may be issued to any individual who has outstanding debts to the University. No person shall park a vehicle on campus except in spaces marked or designated for parking. Parking violations for which citations will be issued include, but are not limited to:

Sec. 5.2 Booting

The Campus Police officers, security guards, or parking enforcement officers will utilize a tire immobilization device (boot) to immobilize parking offenders’ vehicles. The device will be used to immobilize the vehicles of those offenders who have not complied with requests for payment of outstanding parking fines. Vehicles that are parked on campus without displaying a valid permit will be subject to fines, booting and/or towing

a. Police, security, or parking enforcement officers employed by the Campus Police will
have the authority to boot vehicles on property owned by, leased by, or in the control of
the University of North Carolina at Asheville.

b. Individuals who have received in excess of four (4) University parking citations during
the academic year or have accumulated fines totaling $100.00 or more may have their
vehicles immobilized. Payment of all fines will not prevent vehicles from being booted
for the fifth and any subsequent tickets. Vehicles will be towed after being booted once.

c. Vehicles that are booted will have the immobilization device placed on a tire and a warning sticker advising the operator not to move the vehicle placed on the driver’s side
window.

d. Vehicles will remain immobilized until payment of citations is received. If payment is not received the vehicle will be towed from University property and held until payment is made on outstanding parking fines.

e. Boots will be removed by the police, security, or parking enforcement officers only after payment for outstanding citations is made and a mandatory boot removal fee of $25.00 is paid. For vehicles booted after normal business (During evenings 5:00 p.m. to 7:30 a.m. Monday – Friday, including holidays and campus breaks), payment of boot removal fee and any citation issued at the time the boot was placed on the vehicle is required.

Sec 5.3 Towing

At the time a vehicle is towed, the owner will automatically have their parking privileges revoked and that vehicle’s campus permit will no longer be valid. Invalid permits must be returned to the Campus Police Vehicles that are parked on campus without displaying a valid permit will be subject to fines, booting and/or towing. Vehicles are subject to being towed and stored off campus without notice at the owner's or driver's expense for violations including, but not limited to:

• Receiving multiple citations

• Impeding the proper ingress or egress of an emergency vehicle or another vehicle from lawful parking spaces

• Impeding proper access to dumpsters, service zones, construction areas or materials

• Parking within 10 feet of a fire hydrant

• Parking in a Tow-away Zone or Fire Zone

• Parking without authorization in a reserved area

• Parking in an intersection or street, sidewalk, walkway, or crosswalk

• Impeding access to any building, loading zone, “handicap” ramp or other wheelchair access

• Parking when privileges have been revoked

• Leaving an abandoned or disabled vehicle on campus

• Leaving unregistered vehicles near academic buildings past midnight

• Parking without authorization in a “Handicap” Parking space

• Parking in a barricaded or reserved area

• Parking in a 15-Minute space for more than one hour

• Parking in a Bus Stop location

• Or whenever an enforcement officer or Campus Police officer warrants such action

Sec. 5.4 Revocation of Parking Privileges

Revocation of parking privileges will be used as a last resort. Parking privileges will be reinstated only after a new valid permit is purchased at full cost. Vehicles that are parked on campus after privileges have been revoked will be towed at the owner’s expense. When parking privileges are revoked after being towed for the second time, parking privileges will not be reinstated until the end of the current semester and no parking permit may be obtained during this period of time.

Sec. 5.5 Unpaid Citations

Persons or vehicles found in violation of Regulations Governing Traffic, Parking, and the Registration of Motor Vehicles for The University of North Carolina at Asheville will be issued a citation, with penalties as indicated on the citation. All permit users must pay unpaid citations in full before a new permit can be issued.
Unpaid penalties owed by employees of The University of North Carolina at Asheville must be collected at least once annually under the provisions provided by North Carolina General Statute 143-55.3 (Conditional Continuing Employment). Penalties not paid or cleared will result in one of the following actions:

a. Any person who owes outstanding parking citations to the University of North Carolina at Asheville will not be able to obtain a new parking permit until all fines have been paid.

b. Unpaid penalties will be charged against a student's account in the Cashier's Office.

c. Holds will be placed on student records and transcripts.

d. Vehicle may be booted or towed and/or parking privileges may be revoked.

 




ARTICLE 6. PARKING PETITION AND APPEALS PROCESS

Sec. 6.1 Transportation Committee (TC)

The University of North Carolina at Asheville will establish a Transportation Committee composed of faculty, staff, and students. The Faculty Senate will recommend two faculty members along with two other members serving as alternates. The Chancellor’s Staff Advisory Committee will recommend two staff members along with two other members serving as alternates. The President of the Student Government Association will recommend two students along with two other students serving as alternates. The TC members will serve from January 1 to December 31. The group will annually select a chairperson from among its Faculty and Staff members and will periodically meet to provide advice on transportation-related regulations and projects and/or to hear appeals for parking violations. Persons with delinquent parking fines or persons who have received multiple citations for parking violations on campus shall not be eligible to serve on the TC.

Sec. 6.2 Petition and Appeals Process

The Vice Chancellor for Campus Operations will appoint as Hearing Officer, a person having no responsibility with the Campus Police for either the supervision of officers or the financial performance of the department.

a. New Freshman Parking Applications.

1. The Hearing Officer will review all Freshman Parking Applications and
respond to applicants within six (6) weeks of receiving the application.
Applications are available at www.unca.edu/transportation.

2. The applicant can appeal this decision to the Transportation Committee (TC)
in writing within 10 business days of receipt of letter.

b. Parking Citation Notices

1. Individuals issued parking citations and other violation fines and those who
have had their parking privileges suspended may petition the penalty within
10 business days of the date of the citation or letter imposing punishment.

2. Petitions should be filed in writing on a standard petition form available from
Campus Police.

3. All information requested on the petition form must be provided to constitute a valid petition.

4. Only those petitions received during the 10-business day deadline will be
reviewed.

5. The Hearing Officer will review the petition and notify petitioner within 60
calendar days.

6. Petitioners will be notified by mail and/or e-mail of the decision to grant or
deny their request.

7. If the appeal is granted, no further action is necessary and monetary
restitution will be made within 60 calendar days.

8. If the Petition is denied, the petitioner may submit an Appeal at the Campus Police office in Vance Hall within 10 business days of receipt of the denial letter. The Appeal must contain new information from that presented in the
Petition.

9. Upon receipt of the appeal, the Hearing Officer will review it. If the
appeal contains new information it will be forwarded to the TC. The
individual filing the appeal will be notified of the time/date to appear before
the committee.

10. The TC is the final arbitrator of Parking Appeals.


DEFINITION OF TERMS:

The definitions of all terms used in these regulations shall be provided in N.C.G.S. section 20-4.01 and other applicable sections of the General Statutes of North Carolina insofar as they are provided. The meaning or other applicable terms of substitute definitions shall be as follows:

• Abandoned Vehicle. Any vehicle that has been parked illegally for more than five days or which is determined to be derelict, abandoned, or inoperable under North Carolina General Statute 20-137.7.

• Academic Year. From the beginning of the fall semester of one calendar year until the beginning of the fall semester of the ensuing year.

• Alternative Fuel Vehicle. A hybrid vehicle or any vehicle that runs on electricity, fuel cell, natural gas, hydrogen, bio-fuel, or flex-fuel.

• Board of Trustees. Unless otherwise provided, the Board of Trustees of The University of North Carolina at Asheville.

• Boot. A device that when placed on a wheel of a vehicle prevents movement of the vehicle. Also called an immobilization device.

• Bus Stop. Location specifically designed as a bus pullout area. These areas may be used by school buses, transit buses, shuttles, or any other large vehicle to pick up or drop off groups of individuals. Any vehicle left unattended in a bus pullout area may be ticketed and towed at the owner’s expense.

• Campus. All property located in and around Asheville, North Carolina, that is owned by the State of North Carolina and that is under the supervision of the Board of Trustees of The University of North Carolina at Asheville.

• Carpool. An organized group of two or more commuting members of campus who regularly ride together in one car and share the use of a Carpool Permit issued by Campus Police.

• Crosswalk. That portion of a roadway distinctly indicated by lines or other markings on the surface for pedestrian crossing. Pedestrians have the right-of-way on the entire campus.

• Decal. A vehicle window sticker purchased from The University of North Carolina at Asheville Campus Police bearing printed messages, including an expiration date, giving permission to park in designated parking areas.

• Facility User. A person who is neither faculty, staff, nor student but who frequently uses the facilities of the campus such as the library and athletic facilities.

• “Handicap” Parking. Any person with a state or campus issued “handicap” placard may park in any “handicap” parking space as well as in any other regulated parking space, except for service vehicle spaces, reserved spaces, or undesignated spaces. Vehicles may not be parked in any 15-minute space for more than 15 minutes.

• Hangtag. A hanging device purchased from The University of North Carolina at Asheville Campus Police bearing printed messages, including an expiration date, giving permission to park in designated parking areas.

• Intersection. The area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more highways, streets, or roadways that join one another at any angle, whether or not one such highway, street, or roadway crosses the other.

• Impeding. Interfering with or slowing the progress of.

• Liability. Legal responsibility by vehicle ownership, registration, payment or appeal of citation.

• Motor Vehicle. Any motor-powered vehicle, to include automobiles, trucks, motorcycles, motor scooters, and motorbikes, that must be registered under State motor vehicle registration laws and for which license plates are required by State law for operation on streets, highways, and roadways of this State.

• Operator. Every individual who operates a vehicle as the owner thereof, or as the agent, employee, or permittee of the owner, or is in actual physical control of a vehicle.

• Parking Area. Any place or area set aside, marked, or intended for parking of a vehicle, either permanently or temporarily.

• Park/Parking. "Park" or "parking" does not include vehicles actually engaged in: (1) receiving or discharging passengers; (2) obeying traffic regulations, signs, or signals; or (3) stopping involuntarily due to causes beyond the control of the operator of the vehicle.

• Parking Permit. Any permit, permanent or temporary in nature, issued or recognized by The University of North Carolina at Asheville allowing parking of a vehicle in designated areas or spaces on University property. All parking permits including those issued by academic and administrative offices, clinics, and others must be approved by Campus Police. The Campus Police have the sole responsibility for issuance of permanent parking permits.

• Registered Vehicle. Any vehicle registered with The University of North Carolina at Asheville Campus Police by means of the purchase of a parking decal.

• Reserved and/or Restricted. Any space that has been reserved for an individual, entity, event, or service.

• Service Area. Any space, drive, or area indicated by sign(s) or orange color stripes reserving such space, drive, or area for the use of: police, fire, ambulance or similar emergency vehicles; commercial or business vehicles engaged in delivery, loading or unloading, or service to University offices or personnel when such vehicles are conspicuously marked with signs indicating their purpose or ownership; and state-owned vehicles assigned to maintenance or delivery functions or in the process of loading or unloading.

• Sidewalk. All that property along or by any street, highway, or roadway that is intended for pedestrian use and that lies between the curb line or lateral line of any street, highway, or roadway and the line at which the use of property for purposes other than pedestrian traffic ends.

• Staff Members. (1) Faculty, (2) University employees filling permanently established positions, and (3) employees of the University Dining Service.

• Stop. When required, means complete cessation of movement. When prohibited, means any stopping of a vehicle except when necessary in responding to an exigency or to avoid conflict with other traffic or in compliance with the direction of a police officer or traffic control sign or signal.

• Street, Highway, or Roadway. The entire width of every way or place of whatever nature designated or marked by proper authorities for vehicular traffic.

• Student. A person registered for full- or part-time academic study, including special students on the undergraduate or graduate level, other than staff members at the university.

• Temporary Employee. Persons hired to fill non-permanent positions, normally on a short-term basis.

• Vendor. Any person on the campus of The University of North Carolina at Asheville who is neither faculty, staff, nor student, but is providing a service for the campus, qualifies for a vendor pass obtained from the Campus Police during normal business hours (7:30 a.m. to 5:00 p.m. Monday – Friday, except holidays and campus breaks).

• Visitor. Any person on the campus of The University of North Carolina at Asheville who is neither faculty, staff, nor student, with the exception of Facility Users.

• University. Unless otherwise provided, The University of North Carolina at Asheville.

• Unregistered Vehicle. Any vehicle not registered with The University of North Carolina at Asheville Campus Police by means of the purchase of a parking permit.

• Walk or Walkway. A way designated or marked by proper authorities for primary use by pedestrians, whether along a street or roadway or not.

• Weekend. Weekend hours are from 5:00 p.m. Fridays – 7:30 a.m. on Mondays, except holidays and campus breaks. Parking in “handicap” spaces, fire zone spaces, reserved, or 15-minute spaces is monitored during these hours.
