Animal Control On Campus
Purpose
This policy is intended to minimize
the occurrence of offensive odors, excrement, fleas, biological
agents, etc., on the campus and in campus buildings where these may
result in health hazards to personnel or be detrimental to
instructional or research objectives.
Application
This policy is primarily intended to
apply to dogs, but is also applicable to other animals which are
likely to create similar health hazards and/or nuisances.
Animals on Campus Grounds
The laws and ordinances of the City
of Asheville shall apply to the control of animals on the university
campus. Animals brought onto the campus must be restrained as
provided for in the City's Code of Ordinances which include but are
not limited to the following:
- Animals that are off the owners
real property must be under physical control by a competent
person and physically restrained by a chain, leash or harness,
not to exceed eight feet in length and held in the hand of said
person. (section 3-27a)
- Animals are not permitted to
damage the property of another including, but not limited to,
turning over garbage containers, damaging gardens, flowers, or
vegetables, or defecating upon the property. (section 3-28
a 4)
- Animals are not permitted to be
tethered to any public property or in a public
right-of-way. (section 3-27 a 10)
Animals in Campus Buildings
Animals are not permitted in any campus buildings
except in the following cases:
- Animals providing assistance to handicapped
persons.
- Animals working in a law enforcement
capacity.
- Animals used in research and teaching and
authorized by the Vice Chancellor of Academic Affairs.
- Special circumstances or events, subject to
approval from the Health and Safety Office.
Animals in Vehicles
It is unlawful to place or confine an animal or
allow an animal to be placed or confined in a motor
vehicle under such conditions or for such a period of time as to
endanger the health or well-being of such animal due to temperature,
lack of food or drink, or such other conditions as may be reasonably
expected to cause suffering, disability or death. After making
a reasonable attempt to find the driver of a vehicle in which an
animal is confined, Animal Control Officers may enter the vehicle if
necessary to remove the animal, where reasonable cause exists to
believe the animal may die if not immediately removed.
Animal Bite
It is unlawful for an animal to bite a human being
who does not ordinarily reside on the owner's premises, except a dog
being used by a law enforcement officer to carry out law enforcement
duties. The victim of a bite and the animal's owner shall
immediately report the incident to the Campus Police or Asheville
City Police. It shall be unlawful for any person to
withhold accurate information revealing the location of the bite
animal.
Enforcement
Campus Police will work in
conjunction with City Animal Control Officers to address violations
of this policy.
Possible Sanction
Violations of this policy may result
in the following:
- Impoundment or seizure of the
animal.
- The owner may be cited and a
civil penalty incurred.
